Terms of Service – Fundi (Rental Sphere)

1) Who we are
These Terms of Service (“Terms”) govern your use of Fundi, the Rental Sphere WhatsApp AI assistant (the “Service”).

By using the Service (including messaging our WhatsApp number), you agree to these Terms.
2) What Fundi does (Service description)
Fundi is an AI-powered assistant that:
- Answers general questions about rentals and the Rental Housing Act;
- Provides links to learning resources and courses;
- Shares public contact details for relevant industry bodies or professionals; and
- Helps with basic, automated workflows (e.g., FAQs, lead capture, subscription management).
No legal advice. Fundi provides general information only. It is not a law firm and does not provide legal or professional advice. Always consult a qualified attorney or relevant professional for advice on your specific circumstances.
3) Eligibility & your responsibilities
You confirm that:
- You are at least 18 years old;
- The information you provide is accurate and lawful to share; and
- You will comply with these Terms and all applicable laws.
You are responsible for your device, data costs, and keeping your WhatsApp account secure.
4) Using the Service on WhatsApp
- Your use of WhatsApp is also governed by WhatsApp’s Terms and Privacy Policy.
- By messaging our number, you consent to receive replies and transactional messages.
- You can opt-out at any time by sending “STOP”.
5) Accounts, plans & payments (if applicable)
- Some features (e.g., premium content or tools) may require subscription or once-off payment via Netcash or other processors we support.
- Prices, billing intervals, and inclusions will be shown at checkout.
- Auto-renewal: Subscriptions renew automatically until you cancel.
- Cancellation: Cancel any time to stop future renewals; we do not generally issue pro-rata refunds for partial billing periods unless required by law.

6) Content & accuracy
AI responses may be incomplete, outdated, or incorrect. We try to improve accuracy, but you use the information at your own risk. Links to third-party sites are for convenience; we’re not responsible for their content or availability.

7) Acceptable use
You agree not to:
- Use the Service for unlawful, defamatory, infringing, harassing, fraudulent, or harmful activity;
- Attempt to reverse engineer, disrupt, overload, or bypass security;
- Upload or transmit malware or harmful code;
- Scrape or mass-harvest data from the Service; or
- Impersonate others or misrepresent your affiliation.
We may suspend or terminate access if we reasonably believe these Terms are breached.
8) Privacy & data protection
Our Privacy Policy explains what personal information we process and why, consistent with POPIA. By using the Service, you consent to such processing. Key points:
- We process your messages and interaction data to operate, improve, and secure the Service;
- Some processing is performed by trusted operators (e.g., Digital Inertia, WhatsApp/Meta, Netcash, n8n hosting) acting as processors or independent operators as applicable;
- You may exercise POPIA rights by contacting Shaun@rentalsphere.co.za.
9) Service changes & availability
We may modify, suspend, or discontinue features at any time (for example, for maintenance, upgrades, or to address misuse). We will try to avoid downtime and, where reasonable, give notice of material changes.
10) Intellectual property
All content, models, prompts, workflows, software, logos, and brand assets used in the Service are owned by or licensed to Rental Sphere or our partners. You receive a limited, revocable, non-transferable licence to use the Service for its intended purpose. No other rights are granted.
11) Disclaimers
To the maximum extent permitted by South African law:
- The Service is provided on an “as is” and “as available” basis;
- We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components;
- No professional advice: Outputs are informational and not a substitute for professional advice.
12) Liability
To the maximum extent permitted by the Consumer Protection Act, 2008 (CPA) and other applicable law:
- We are not liable for indirect, consequential, special, or punitive damages;
- Our total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) R1,000 or (b) the amounts you paid to us for the Service in the 3 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
13) Indemnity
You agree to indemnify and hold Rental Sphere (and our directors, employees, and partners) harmless from claims, damages, liabilities, costs, and expenses arising from your unlawful use of the Service or breach of these Terms.
14) Consumer & E-commerce disclosures (SA)
We aim to comply with the Electronic Communications and Transactions Act, 2002 (ECTA) and the CPA. If you believe your consumer rights have been infringed, please contact us at shaun@rentalsphere.co.za so we can try to resolve the issue.
15) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will change accordingly. If changes are material, we will take reasonable steps to notify you (e.g., posting on our site or a WhatsApp notice). Continued use after changes means you accept the updated Terms.
16) Termination
You may stop using the Service at any time (send “STOP” to opt out on WhatsApp). We may suspend or terminate access if you breach these Terms or we discontinue the Service.
17) Governing law & disputes
These Terms are governed by the laws of the Republic of South Africa. Where informal resolution fails, disputes shall be submitted to the jurisdiction of the High Court of South Africa (or another competent South African court). Nothing prevents a party from seeking urgent relief.
